ECCN – Export Control Classification Number

If you ship a commercial item from the United States to a foreign destination, your transaction is likely to be subject to the jurisdiction of the U.S. Department of Commerce. The Bureau of Industry and Security (BIS) within the U.S. Department of Commerce has jurisdiction over the export and re-export of “dual-use” items (i.e., commodities, technology and software that have both civilian and military or proliferation applications). These controls are implemented through the Export Administration Regulations (EAR). If your item is subject to the jurisdiction of the U.S. Department of Commerce, you should first determine if your item is designated by an Export Control Classification Number (ECCN) on the Commerce Control List (CCL). The ECCN is a key factor in determining whether you need a license to export dual-use items outside of the U.S.

What is an ECCN?

An Export Control Classification Number (ECCN) is an alphanumeric designation (i.e., 1A984 or 4A001) used in the CCL to identify items for export control purposes. An ECCN categorizes items based on the nature of the product, i.e. type of commodity, technology or software and its respective technical parameters. Once the ECCN has been identified, you can determine the reasons for control of the item, which transactions may require an export license based on the country of destination, and which license exceptions, if any, may apply. What is an EAR99 designation?

Items that are subject to the jurisdiction of the EAR but are not on the CCL, are designated EAR99. EAR99 serves as a “basket” category for all such items. As stated above, Xmultiple connectors have the EAR99 designation.

A: CCATS – Commodity Classification Automated Tracking System. The CCATS is the number assigned by the BIS to the documentation of a product’s formal review and classification against the CCL (Commerce Control List).

Xmultiple Controlled Technology

The EAR provides that the release of technology or software to a foreign national is an export. Xmultiple products are not regarded as this type of technology. Xmultiple does not have software products.

A foreign national is anyone who is not a U.S. citizen, U.S. permanent resident alien, or a lawfully admitted refugee. Exports occur in everyday disclosure of information to a foreign national via consultation, training, company visits and conversations through email, fax and telephone.

Q: What is a “deemed export?

A: A deemed export release in the United States is a release of technology or source code that is subject to the EAR to a foreign national. Such release is “deemed” to be an export to the home country or countries of the foreign national.

  • Visual inspection (such as reading technical specifications, plans, blueprints, etc.)
  • Oral exchange of technology, including when technology is made available by practice or application under the guidance of person with knowledge of the technology
  • Posting information on a website or FTP site for downloading

  • Specific information related to all stages prior to serial production, such as design, design research, design analyses, design concepts, assembly and testing of prototypes, pilot production schemes, design data, process of transforming design data into a product, configuration design, integration design and layouts.
  • Specific information related to all production stages such as product engineering, manufacture, integration, assembly (mounting), inspecting, testing and quality assurance.
  • Specific information related to an item’s operation, installation (including onsite installation), maintenance (checking), repair, overhaul and refurbishing.
